On 27 March 2014 the Government published The Copyright and Rights in Performances (Research, Education, Libraries and Archives) Regulations 2014
The draft Statutory Instrument as published can be accessed here
The Regulations will effect the changes to the scope of s 35 and paragraph 6 Schedule 2 Copyright, Designs and Patents Act 1988 which have been expected and discussed with ERA members and representatives of educational establishments over the last year.
The changes have led to the preparation and launch of the new ERA Licensing Scheme that will be applied for ERA licences granted on or after 1 April 2014.
New ERA Licences will apply for all schools whose licences fall due for renewal from 1 April 2014.
The terms of ERA or ERA Plus Licences which were granted before 1 April 2014 and which run for a Licence Period that runs beyond 1 April 2014, will be unaffected and continue in force until the end of their Licence Period(s).
Renewals will then be offered by reference to the new ERA licensing scheme.
Further information about the new ERA Licence can be accessed.
