New Regulations implemented from 1 June 2014 to support the new ERA Licence


The Copyright and Rights in Performances (Research, Education, Libraries and Archives) Regulations 2014 came into force on 1 June 2014. You can access the Regulations – S.I. 2014 No 1372.

The Regulations confirm the changes expected to s 35 and paragraph 6 Schedule 2 Copyright, Designs and Patents Act 1988, under which the new ERA Licensing Scheme will now operate.

The new provisions of s 35 (4) and paragraph 6 (4) Schedule continue to provide that the recording and use of copies of recordings of broadcasts (including radio and television broadcasts) are subject to the terms of ERA Licences linked to the provisions “to the extent that, licences are available authorising the acts in question and that the educational establishment responsible for those acts knew or ought to have been aware of that fact”.

ERA has published details of its new ERA Licence so that all educational establishments are able to access its schedule of terms.
